What has changed

Australia's gambling advertising environment has become more restrictive for influencer and social media promotion. The Australian Communications and Media Authority (ACMA) and state-level gambling regulators have increased enforcement activity around undisclosed affiliate relationships, gambling promotions targeting minors, and misleading depictions of gambling outcomes in social media content.

Operators and affiliates working with influencers in Australia are required to ensure commercial relationships are clearly disclosed, content does not target under-18 audiences, and promotional content does not misrepresent the probability of winning or the typical player experience.

What the rules require

  • Clear disclosure of paid or affiliate relationships in gambling content
  • No targeting of gambling content at audiences below legal gambling age
  • No content that presents gambling as a reliable or likely source of income
  • Responsible gambling messaging requirements in promotional content

These requirements apply to both operators and influencers. Operators remain responsible for ensuring their third-party marketing partners comply.

Enforcement

ACMA has the authority to issue infringement notices and refer cases for prosecution. Several operators have received formal warnings or fines related to non-compliant social media marketing in recent regulatory cycles. Enforcement activity has increased alongside the growth of gambling content on short-form video platforms.

What this means for players

Players who encounter gambling content via influencer channels should be aware that affiliate relationships are a financial incentive for positive depictions of operators, regardless of the actual player experience. Influencer gambling content is marketing, not independent review.

When choosing an operator, verify licence status, withdrawal terms, and bonus conditions directly rather than from influencer recommendations. The financial relationship between influencer and operator means their incentive is to drive registrations, not to protect player interests.
